Mecklenburg County} July Term 1850
                    To the worshipful the Justices of the Court of Pleas & Quarter Sessions
          The petition of Stanhope S. Hoover and Samuel L. Hoover by his Guardian S. S. Hoover hereby showeth unto your worships that your petitioners are the heirs at law & Devisees of their father the late Philip Hoover & that the Said Philip Hoover died in this County and by his last will and testament left your petitioners tenants in common of a tract or parcel of land lying in this County of Mecklenburg & State aforesaid being upon the waters of Catawba River adjoining the lands of George Cathey Jonathan Reid William Porter & others Containing about 230 acres more or less -- your petitioners further show unto your worships that they are the only tenants in common or owners of said land & that the said Stanhope Hoover is of full age & that said Samuel Hoover is represented here by his Guardian.
          In as much as your petitioners desire a division of said lands they would pray your Worships to appoint three freeholders to make said division and allot to cash one of your petitioners in severalty their portion of said land & as in duty bound your your [sic] petitioners ever pray

          You are hereby commanded to summon James Porter - Jonathan Reed & William Porter personally to be & appear on the premises together with James Parks the County Surveyor at such time as you Shall appoint -- then and there to divide and make partition of the lands held by the heirs at law of Philip Hoover as tenants in Common as prayed for in the foregoing petition & have you the proceedings together with this writ before the Justices of our Court of Pleas & Quarter Sessions to be held for the County of Mecklenburg at the Court house in Charlotte on thefourth Monday in October next -- herein fail not
